I, the undersigned participant, acknowledge that my participation in the "The Viking Initiation | Norway 2023" event (hereinafter referred to as the "Event") hosted by Yager Transformation Group, LLC, a Delaware limited liability company (the “Company"), involves known and unanticipated risks and hazards. These risks include, but are not limited to, physical or emotional injury, paralysis, death, and damage to myself, to property, or to third parties. I understand that such risks cannot be completely eliminated and may be caused by varying conditions such as terrain, facilities, temperature, weather, lack of hydration, physical condition of participants, equipment malfunctions, vehicular traffic, and actions of others, including but not limited to, participants, volunteers, spectators, event officials, event monitors, and/or producers of the Event.
Assumption of Risks
I affirm that I fully understand the nature and extent of the risks involved in the Event. By signing this form, I voluntarily agree to accept and assume all risks, both known and unknown, inherent or otherwise, associated with my participation in the Event. I assume full and complete responsibility for any injuries, damages, losses, liabilities, costs, or expenses that I incur as a result of participating in the Event.
Health Declaration
I hereby certify that I have either:
(a) undergone a comprehensive physical examination and have been given medical clearance by a qualified healthcare provider to participate in the Event; or
(b) chosen to participate in the Event without seeking medical advice and clearance.
I acknowledge and accept full responsibility for this decision and its potential implications. I hereby release, discharge, and covenant not to sue the Company and all other parties affiliated with the Event, including but not limited to, its parent companies, affiliates, subsidiaries, event organizers, sponsors, event directors, officials, contractors, advertisers, volunteers, staff, agents, representatives, and each of their respective insurance carriers, underwriters, subrogated agents, successors, and assigns (collectively, "Releasees"), from any and all liability, claims, demands, legal actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, related to such a decision, whether arising from the negligence of the Releasees or otherwise.
Waiver of Liability and Indemnification
In consideration for allowing my participation in the Event, I voluntarily agree to the following:
(A) To waive, relinquish, discharge, release, and covenant not to sue the Company and Releasees from any and all claims arising from or related to any direct, indirect, incidental or consequential damages, injuries, losses, or death that I may suffer as a result of my participation in the Event.
(B) To indemnify and hold harmless the Company and Releasees against any and all legal claims, actions, suits, procedures, costs, expenses, damages, and liabilities,
including attorney's fees, arising out of or related to my actions or conduct during the Event.
(C) To consent to receive medical treatment, including but not limited to first aid or emergency medical services, as may be deemed advisable in the event of injury, accident, and/or illness during the Event. I acknowledge and understand that I will be responsible for any and all medical and related bills that may be incurred as a result of any medical treatment for me.
Governing Law and Broad Interpretation
This Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under the applicable law of Delaware. I certify that I have read, understood, and voluntarily agree to the terms stipulated in this document.
